The death of a loved one is always a difficult situation to deal with. It is especially hard to cope with this loss when that person is killed due to a situation that was not his fault. Fatal accidents are shocking, sudden and tragic, which is why one Texas man’s estate is seeking a $5 million dollar wrongful death claim for the pain and suffering they have endured due to the loss of their loved one.
The deceased was a passenger in a vehicle leased by the industrial service company for which he worked. The driver was allegedly intoxicated while operating the vehicle. The driver was said to have lost control of the vehicle, causing an accident which fatally injured his passenger and coworker.
The estate aims to sue both the deceased’s company as well as the driver of the truck. The lawsuit states that the driver was reportedly intoxicated and negligently operated the vehicle, and the estate claims that the company is also at fault for negligent entrustment. Investigations are currently underway into the validity of these claims.
The family has endured pain and suffering due to the loss of their loved one, and they are pursuing this lawsuit in order to be compensated for their anguish. In Texas, the claims must be investigated to prove the validity of the driver and company’s alleged negligence in order for a wrongful death claim to be successful. If the claims against both the driver and the company are upheld in court, the estate could be compensated for the financial losses and other damages resulting from this fatal accident.
