A tragedy occurred recently in Texas that has left a father mourning the loss of his young son. Drunk driving is the suspected cause of the tragic accident. The boy’s father was a witness to the events that led to the death of his son.
The motorist alleged to have caused the recent crash is a 24-year-old man. The father of the 4-year-old boy who died watched as the car driven by the man missed a curve in the road and went barreling through a wall of the family’s house into his child’s bedroom. Reports indicate that the boy died instantly upon impact. His brothers, who were sleeping in the same room, survived the crash without injury.
Consumption of alcohol and excessive speed are said to be leading factors in the case. The boy’s father said that he heard the speeding car heading in his direction and went outside to see if, perhaps, a police chase was happening in his neighborhood. He stated that as soon as he saw the approaching car, he could tell that it was not going to make the curve. After the car plowed through his house, he went to check his sons; he felt the foot of the child who had been sleeping on the floor and knew, immediately, that he had not survived.
The driver has been charged with intoxication manslaughter as well as injury to a child. In similar circumstances, a person who suffers the untimely death of his or her loved one in a drunk driving accident is protected under Texas law by the right to file a wrongful death claim in a civil court. In a successfully litigated case, compensation can be awarded by the court that could be used to help offset funeral costs and any other expenses incurred because of the accident.
