Father and son die in possible wrongful death crash in Texas

Tragic accidents can happen at any time. Unfortunately, a family that was vacationing in Texas never made it home after being involved in a car accident. Reports indicate that a father and his son died in the accident, leaving the man’s wife potentially able to file a wrongful death claim against the negligent driver who is believed to have caused the accident.

The accident happened on Interstate 30 in late December after a previous accident involving a tractor-trailer that caught on fire slowed traffic. While stopped due to the semi-truck accident, the SUV in which the family was traveling was rear-ended by another SUV, and the impact caused the family’s vehicle to erupt into flames. The man and his son were killed as a result of the fire. The man’s wife, who was also in the vehicle, was burned and taken to a nearby hospital for treatment.

The driver of the other SUV was taken to a medical facility for treatment of his injuries, and he is expected to survive. The case has been handed to a grand jury to determine if the driver should be formally charged for failing to travel at an appropriate speed. The scene was investigated, but no other information about the matter has yet been reported.

Surviving family members are often unsure of where to turn when they learn that their loves ones were killed in a car accident. Fortunately, in many cases, they can turn to the civil court system. In this case, the driver of the larger SUV could be criminally charged and could also face civil litigation if the man’s wife decides to pursue legal action. She has the right to file a wrongful death claim against the other driver in a Texas civil court in an attempt to recover damages that resulted from this tragedy.
