Tragic accident results in plans for a wrongful death lawsuit

In the state of Texas and throughout the United States, when immediate family members suffer the untimely death of a loved one due to the negligence or wrongful actions of another person, they are permitted by law to pursue legal action against the at-fault party in order to seek compensation for damages suffered. A recent case involves a mother who is apparently planning to file a wrongful death suit in the aftermath of her daughter’s tragic death. The young woman was killed in an accident earlier this year. Two others were with her when the accident occurred.

The 28-year-old was out in the field with her 30-year-old boyfriend and his boss, both of whom work for a communications tower maintenance company. The men had accompanied the young woman to a communications tower so that she could attempt to climb it and demonstrate her capabilities in the hope of attaining employment with the company. Reports indicate that she had never climbed a tower before that day.

The 40-year-old boss that was with the woman was observing her climb; he had gone up and back down the tower himself in order to show the proper procedure for climbing. He claims that he was on his cell phone when he heard the woman’s boyfriend scream. He soon realized that the woman had fallen off a high point on the tower and plummeted to the ground. The men called emergency crews, who transported her to a nearby hospital; sadly, however, she did not survive her injuries.

During early investigations after the accident, it allegedly came to light that one of the hooks on the woman’s climbing harness was not properly hooked. Her mother has reportedly hired legal counsel to help her file a wrongful death claim in the aftermath of the tragedy. When there has been loss of life and another person’s negligence has caused the death, a court can order a compensatory award in a successfully litigated case, holding the responsible party or parties liable for the actions that resulted in a person’s death.
