A fatal accident has a gut-wrenching consequence, not only for the victim, but for the family and those who depend on them. In addition, a car accident can cause serious injuries to surviving victims. This is apparently true for a car accident that occurred on our Texas roadways in the recent weeks.
The deadly car accident took place in Denton County on a Saturday night. According to reports, the driver of a Lexus was driving at an excessive rate of speed when the vehicle slammed into the back of a Jeep SUV, south of the Josey Overpass. The initial impact caused the Jeep to roll over and the Lexus to catch on fire. Both of the vehicles ended up off the road and into grassy areas.
Tragically, the driver of the Jeep died. Medical crews arrived and transported the passenger to the Medical Center of Plano where the person was listed in serious condition. Reportedly, none of the occupants in the Lexus were seriously injured.
It’s likely that the family of the deceased driver is overwhelmed by the recent tragedy. The family members may have legal recourse to pursue a wrongful death claim against the driver of the Lexus as an appropriate remedy on behalf of the victim. The injured passenger may also have the right to file a personal injury claim to cover lost wages and medical expenses under our Texas laws. The civil court system may award damages if there is substantial evidence that demonstrates that the driver of the Lexus was responsible for the car accident and operated in a negligent manner.
