Wrongful death lawsuit filed after fatal motorcycle crash

When the negligence of a driver results in a fatal auto accident, the result can be criminal charges for the driver. In addition, the family left behind has the right to pursue civil litigation as well. This right is being exercised by the mother of a young man who was killed in motorcycle accident in October. As she continues to move through the early stages of grief, the woman has filed a wrongful death suit against the driver involved in the crash. On behalf of her son, the woman has filed the suit in a federal court in Galveston, Texas.

The accident happened on the U.S. 90 in the vicinity of Alkire Lake Drive. At the time of the crash, the 18-year-old motorcyclist was traveling eastbound U.S. 90. Police believe that the other driver, who was travelling westbound on the same roadway did not yield the right-of-way to the motorcyclist. It is believed that the driver attempted to cross four lanes of traffic before crashing his vehicle into the motorcyclist.

The 18-year-old man was rushed to Memorial Hermann Downtown Hospital for emergency medical treatment. Unfortunately, he was unable to survive the injuries sustained in the wreck, and died at the hospital. As for the driver, it is unclear whether he faces criminal charges in the matter. However, he is being held liable for the accident in the recently filed wrongful death suit, in which he is being blamed for multiple failures, including failing to keep a proper lookout, failing to apply brakes in a timely and proper manner and failing to avoid the fatal collision.

No legal outcome will be truly satisfactory to the family who lost their loved one in this terrible car crash. Unfortunately, those who drive without due diligence and care can cause accidents that lead to a loss of life. However, this wrongful death lawsuit can help the family of the decedent to cope with some of the financial losses from medical expenses, funeral costs, and other damages. It may also bring closure to the Texas family if they feel that some small measure of justice has been handed down against the responsible party.
